Contested Divorce

In a contested divorce, husband and wife cannot agree on how to divide their property or custody of the children. Both husband and wife need to retain separate attorneys. The lawyers negotiate on behalf of their respective clients to attempt to settle the case. If the attorneys cannot reach a mutual agreement, the case is set for trial.

  COSTS:  
  The Initial Costs of a Divorce, (as Described Previously) 16.0 hrs
  Plus:  
1. Draft Answer & Cross Petition 2.0 hr
2. Draft Proposal Letter to Opposing Counsel 2.0 hr
3. Phone Calls with Opposing Counsel (RE: Settlement Negotiations) 1.0 hr
4. Phone Calls with Client to Convey Proposals from Opposing Counsel 1.0 hr
5. Two Settlement Conferences with Judge 5.0 hrs
  Total Hours: 27.0 hrs

 

Discovery

If Discovery is necessary, add the following costs:

  COSTS:  
  Contested Divorce Costs, (as described above) 27.0 hrs
  Plus:  
1. Draft & Answer Interrogatories 5.0 hrs
2. Draft & Answer Request for Production of Documents 5.0 hrs
3. Draft and Serve Subpoenas ($500/subpoena for preparation & service and charge by company) 2.5 hrs
4. Take Deposition of Opposing Party (including question preparation) 8.0 hrs
5. Defend Deposition of Client (including preparation time) 8.0 hrs
6. Obtain Appraisals of House/Pension/Real Estate, etc. 4.0 hrs
  Total Hours: 59.5 hrs

 

Other Posible Costs

  COSTS:  
1. Order of Protection (to get a restraining order against spouse) 10.0 hrs
2. PDL Hearing (includes hearing preparation and representing client at the hearing) 15.0 hrs
3. QDRO Preparation (a QDRO is a document which divides a deferred compensation plan which is in only one spouse’s name) 4.0 hrs
4. Trial 30+ hrs
